Terms of service
Version: 2 November 2026
Article 1. Business and applicability
-
FOREFACT is a trade name of a sole proprietorship (eenmanszaak) registered in the Netherlands.
-
These terms and conditions apply to the purchase and delivery of all digital products via the FOREFACT online shop: guides, Founder Stories, Programs, packs and bundles, and gift cards. Wherever these terms refer to a ‘product’, all of these products are meant.
-
By placing an order, the customer enters into an agreement with FOREFACT.
-
Before the agreement is concluded, the terms are made available in a way that allows the customer to store them.
-
Statutory consumer rights always continue to apply. In the event of a conflict between these terms and mandatory consumer law, the law prevails.
Article 2. Products
-
Guides are digital documents in PDF format about a specific decision or a specific topic. Some guides come with an Excel workbook.
-
Founder Stories are digital documents in PDF format about the decisions behind a company, with assignments and worksheets. They are written independently by FOREFACT; the entrepreneurs and companies mentioned are not involved.
-
Programs are digital series of lessons in PDF format for personal development. They are not therapy, not tailored coaching and not medical advice.
-
Packs and bundles are a fixed combination of several products at a bundle price. The parts are delivered as separate files. The product page states which parts are included and what they would cost separately.
-
A gift card is digital credit that can be spent on products in the online shop.
-
The product page describes the topic, the main features, the content and the price of the product concerned.
-
The content is based on information and sources that were available during the period in which the research was carried out. FOREFACT strives for careful, verifiable and usable information. Absolute completeness, or that the content will remain up to date, cannot be guaranteed.
-
A product is not individually tailored legal, tax, financial or other personal professional advice.
Article 3. Prices, discounts and payment
-
The applicable price is stated on the product page and is confirmed before the order is placed.
-
For consumers, prices are shown including VAT.
-
Discount codes and promotions apply under the conditions stated with the code or promotion. They cannot be exchanged for cash and cannot be offset retrospectively. FOREFACT may end a discount code; this does not affect orders that have already been placed.
-
Any discounts are shown before the final payment.
-
Payment is made using the payment methods made available in the online shop. Digital delivery starts once the payment has been processed successfully.
-
FOREFACT does not charge any unexpected additional costs after the order has been completed.
Article 4. Formation of the agreement
-
The customer selects one or more products and completes the ordering process.
-
Before the order is finally placed, the customer has the opportunity to check the order and the total price.
-
The customer receives a confirmation of the order at the email address provided.
-
In the event of an obvious error in the price or product description that the customer should reasonably have recognised, the applicable statutory rules may have consequences for the agreement.
-
FOREFACT may investigate fraudulent payments or misuse and, where permitted by law, refuse or cancel orders.
Article 5. Digital delivery
-
Products are delivered digitally. There is no physical shipment.
-
After successful payment, the purchased files are made available via the download page and by email to the email address provided.
-
The customer is responsible for entering the email address correctly and for having suitable software to open PDF files and, where applicable, Excel files.
-
If a download is not available or does not work technically, the customer can get in touch via info@forefact.nl. FOREFACT will then provide a working download or another appropriate solution, without prejudice to the customer’s statutory rights.
Article 6. Right of withdrawal for digital products
-
For distance contracts, consumers in principle have a statutory right of withdrawal of 14 days.
-
For digital content that is not supplied on a tangible medium, this right lapses as soon as delivery has begun, if the consumer has expressly consented in advance to delivery during the withdrawal period, has acknowledged that the right of withdrawal is lost as a result, and FOREFACT has confirmed this consent and acknowledgement by email.
-
If these conditions have not been met, the statutory right of withdrawal continues to apply to the extent provided by law.
-
A pack or bundle is one product. The right of withdrawal applies to the pack as a whole.
-
If a consumer validly withdraws, the refund is made in accordance with the law, in principle within 14 days of receipt of the notice of withdrawal.
-
A withdrawal request can be submitted via the online function of the online shop or via info@forefact.nl. More information can be found in the returns and refund policy.
Article 7. Problems, conformity and refunds
-
A digital product must comply with the agreement and with the reasonable expectations the customer may have on the basis of the product information and the law.
-
In the case of a non-working, incomplete, incorrect or otherwise non-conforming delivery, the customer can contact FOREFACT. Where required, FOREFACT will provide a repair free of charge or another appropriate statutory remedy.
-
If a repair is not possible or does not take place within the statutory conditions, the consumer may be entitled to a price reduction or to termination of the agreement and a refund. For a pack or bundle, any price reduction is determined reasonably on the basis of the part concerned.
-
The lapse of the right of withdrawal when digital delivery has lawfully started does not affect the statutory rights in respect of non-conformity.
Article 8. Right of use, sharing and intellectual property
-
The copyright and other intellectual property rights in all products, including texts, layout, workbooks, worksheets and images, belong to FOREFACT or the relevant rights holders.
-
With the purchase, the customer receives a personal, non-exclusive and non-transferable right of use. A business buyer may use the product within its own business.
-
The customer may download the files, store them on their own devices, make a backup copy and print them for their own use.
-
Without FOREFACT’s prior written permission, it is not permitted to forward, share or copy files or parts of them for others, to upload them to websites, social media, cloud folders or chat groups, or to publish, rent out, resell or incorporate them into one’s own product or course.
-
Anyone who wants to give a product as a gift can buy a gift card or order the product for that person. The right of use then passes to the recipient; the buyer does not keep a copy.
-
Quoting short extracts with acknowledgement of the source and using facts and general knowledge remain permitted to the extent allowed by law.
-
In the event of a breach of this article, FOREFACT may block access to downloads and claim compensation for the damage suffered.
Article 9. Gift cards
-
A gift card can be spent on all products in the online shop, including in several parts.
-
A gift card cannot be exchanged for cash, unless the law requires this.
-
The gift card is delivered by email. Treat the code like cash: FOREFACT is not liable for use by others if the code has been shared or lost.
Article 10. Research, sources and timeliness
-
FOREFACT carries out research based on, among other things, public publications, regulations, market information and other available sources.
-
Where relevant, a distinction is made between established information, calculations, estimates and signals from practice.
-
Amounts, margins, risks and scenarios stated may change due to market conditions, personal circumstances or changes in regulations. The content reflects the situation at the time of the research; this does not mean that all data has been checked again at the time of purchase.
-
The customer remains responsible for checking current information relevant to their own situation before making binding financial, legal or business decisions.
-
A product does not guarantee any particular business, financial or personal outcome.
Article 11. Corrections and updates
-
FOREFACT may correct or update products when there is reason to do so.
-
Not every change in market prices, regulations or circumstances means that the original content was incorrect at the time of publication.
-
Unless expressly offered otherwise, the purchase does not give an automatic right to future new editions or extensively revised versions. This does not affect the statutory obligation to supply digital content in conformity with the agreement and, where required, to make necessary repairs available.
-
Possible errors can be reported via info@forefact.nl.
Article 12. Liability
-
FOREFACT is responsible for fulfilling its statutory and contractual obligations.
-
General information is no guarantee that a specific decision is suitable or successful for every customer.
-
FOREFACT is not liable for damage resulting solely from circumstances outside its responsibility or from use of information contrary to clear, relevant warnings, to the extent permitted by law.
-
Nothing in these terms excludes liability or limits rights where this is not permitted under mandatory law.
Article 13. Complaints and contact
-
Complaints about orders, payments, digital delivery or content can be reported via info@forefact.nl. Please include the order number and the product concerned.
-
FOREFACT confirms receipt of a complaint and handles it within a reasonable period, at the latest within 14 days. If more time is needed, FOREFACT will say so within that period.
-
The customer always retains the right to use statutory procedures and competent authorities.
Article 14. Privacy and cookies
-
FOREFACT processes personal data as described in the privacy policy, including for orders, digital delivery, customer contact and administration.
-
For cookies and similar technologies, the privacy policy and the choices the customer makes via the online shop’s cookie preferences apply.
Article 15. Changes and applicable law
-
FOREFACT may amend these terms and conditions for future agreements. An order is governed by the terms that were available when the agreement was concluded.
-
Agreements with FOREFACT are governed by Dutch law. For consumers in other countries, the mandatory protective rules of their country continue to apply.
-
Disputes may be submitted to the court that has jurisdiction under the law.
-
If an individual provision proves to be invalid, the other provisions remain in force.
